Probate is a court process used to oversee the administration of a deceased person’s estate. While we are alive, we can manage our property with full legal authority. Once we pass-away, however, our property remains and needs to be taken care of. In order to take care of that property someone needs to be given the proper legal authority to access, and ultimately distribute the property according to our wishes.

The goal of a probate process:

  • Grant a qualified individual with that authority
  • Ensure that the last wishes of a deceased person are carried out
  • Resolve matters (such as creditors or business concerns) smoothly and efficiently

It’s important to remember that probate laws and procedures are very state specific, and while most states function in similar ways when it comes to probate, each state will almost certainly have unique requirements that you should be aware of.
