FAQ: Do I need a reason to file the Divorce?

By Asa LaMusga

This can vary depending on your location. Many states are “no fault” divorce states. This means that the only reason you need to file a divorce is that your marriage is “irretrievably broken” or that you and your spouse have “irreconcilable differences.”
Some states, are “fault/no fault” states. This means that you can ask for a divorce due to certain instances which have occurred in your marriage, for example if your spouse has committed adultery, willfully deserted you, or is addicted to drugs as well as other reasons.
Depending upon the state you reside in there may be a reason to allege specific grounds if you decide to file for divorce.

In any case, you and your lawyer will evaluate if alleging a specific reason for divorce will benefit you.
